The Ohio Supreme Court's decision to uphold a law limiting the money damages that can be awarded in pain-and-suffering lawsuits could discourage people from pursuing those lawsuits and eliminate a deterrent for companies to fix defective products, trial lawyers said. The issues were raised by Melisa Arbino, a suburban Cincinnati woman who sued Johnson & Johnson Pharmaceutical Co. in Toledo federal court claiming she suffered brain and lung blood clots from using a hormonal birth control product known as the Ortho Evra birth control patch. Johnson & Johnson agreed to pay $1.25 million to settle a lawsuit over the death of a 14-year-old girl who used the company's Ortho Evra birth-control patch, according to court records. The confidential agreement involved Alycia Brown, a resident of LaCrosse, Wis., who suffered two blood clots in her lungs on May 7, 2004, after using the patch for several weeks. More...

The numbers keep adding up for the Ortho Evra birth-control patch. Not sales -- those are down sharply -- but the docket of product liability cases filed against Johnson & Johnson, the maker of the one-of-a-kind contraceptive. In its latest update last month, J&J said more than 2,400 Ortho Evra lawsuits are queued up in state and federal courts. More...

Kansas City Daily Record (Kansas City, MO), "Birth control patch led to embolism, suit filed in federal court says"
Leslie Walquist will never make the decision whether to have children because she suffered a near fatal pulmonary embolism at age 25 after using the Ortho Evra birth control patch, a lawsuit filed Wednesday in federal court claims. Walquist suffered a blockage in her lung artery from a blood clot in May 2004, a direct result from the patch, the lawsuit alleges. She won't be able to have children because of the injuries she suffered, it says. The suit claims the manufacturers, Johnson & Johnson and Ortho-McNeil Pharmaceutical, Inc., should have known of the risks at the time of Walquist's use, even if they didn't make an official warning regarding the patch until Nov. 10, 2005.
